These Terms & Conditions ("Terms") govern your access to and use of altatierradigital.com, ATD website content, contact and inquiry forms, waitlists, early-access communications, and other public website features provided by Alta Tierra Digital ("ATD," "Alta Tierra Digital," "we," "us," or "our").

Please read these Terms carefully.

1. ATD's Current Development Status

Alta Tierra Digital is developing AI-powered automation and operational technology.

Certain ATD Platform capabilities, ATD Engines, integrations, features, pricing structures, security functionality, and other services described on the website may be:

5. Waitlist and Early Access

Joining an ATD waitlist does not constitute a purchase, reservation, guarantee of service, or guarantee of any particular launch date.

Waitlist participants may receive:

ATD may change, postpone, limit, or discontinue a waitlist, beta program, early-access program, or planned offering.

6. Contact and Inquiry Forms

Submitting an inquiry to ATD does not obligate ATD to accept a project or provide a service.

Information submitted through a general website form should not contain passwords, payment credentials, Social Security numbers, protected health information, confidential trade secrets, or other highly sensitive information unless ATD has specifically provided an approved secure process for that information.

7. No Professional Advice

ATD provides technology, automation, operational systems, and related business services.

Unless ATD expressly agrees otherwise in writing, information provided through the public website is not:

8. AI and Automated Technology

ATD may develop or use artificial intelligence and automated systems to support certain services and business processes.

A third party's failure, outage, modification, pricing change, API change, or discontinuation may affect an ATD-related system.

11. Intellectual Property

Unless otherwise stated, the ATD website and its original content, branding, visual systems, designs, text, graphics, logos, software, documentation, ATD Engine concepts, business materials, and other proprietary materials are owned by or licensed to Alta Tierra Digital and are protected by applicable intellectual-property laws.

You may not reproduce, distribute, sell, license, reverse engineer, create derivative works from, or commercially exploit ATD proprietary materials without authorization.

No rights are granted except those expressly provided in writing.

12. Your Submissions

You retain ownership of information and materials you lawfully submit to ATD.

You represent that you have the right to provide information you submit and that doing so does not unlawfully violate another person's privacy, confidentiality, intellectual-property, contractual, or other rights.

You authorize ATD to process submitted information as reasonably necessary to respond to your inquiry, evaluate a requested service, operate ATD systems, and perform other purposes described in the ATD Privacy Policy or an applicable agreement.

13. Acceptable Use

You may not use the ATD website or services to:

ATD may use technical, administrative, and organizational safeguards designed to protect its website and systems.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Alta Tierra Digital and its operators will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of or inability to use the public website.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

Customer-specific liability terms for paid services will be governed by the applicable executed agreement.

18. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of the ATD website, your violation of these Terms, or your infringement of another person's rights.

Any separate customer agreement may contain different or additional indemnification terms.

19. Privacy

Your use of the ATD website is also subject to the ATD Privacy Policy.

The Privacy Policy explains how ATD may collect, use, disclose, retain, and protect information associated with website interactions.

20. Separate Customer Agreements Control

If you become an ATD customer, beta tester, subscriber, or enterprise client, additional agreements may apply.

If a signed customer agreement conflicts with these general website Terms regarding the paid service covered by that agreement, the signed customer agreement controls to the extent of the conflict.

21. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to any different dispute-resolution provision contained in an executed customer agreement, disputes concerning these public website Terms may be brought in a court of competent jurisdiction in Texas.

22. Changes to These Terms

ATD may update these Terms as its business, technology, services, website, or legal obligations evolve.

The Last Updated date will identify the most recent version.

Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

24. Entire Website Terms

These Terms and the ATD Privacy Policy constitute the general terms governing use of the public ATD website.

They do not replace separate written agreements governing paid, beta, enterprise, or other specialized ATD services.
